Ombudsman clears borough council

WARRINGTON Borough Council has been cleared of maladministration following a complaint from a resident over a planning issue.
A resident of the housing development on the former Carrington Wire site complained that permission was granted for light industrial and office use, general industrial uses and storage and distribution which would cause noise, additional traffic and a loss of sunlight.
He complained to the Local Government Ombudsman that the development was inappropriate in a residential area and that he had bought his home after being led to believe by the developer that there would be a greater distance between his house and the proposed development.
The Ombudsman said at the time the complainant bought his house, the council had already granted outline planning consent for mixed business and residential use but had not yet considered detailed design and siting.
The complainants’ solicitor should have been able to advise at the time that details of the proposed development had yet to be decided.
If the resident felt he had been misled by the developer he could take legal action – but ultimately it was a matter for the complainant to satisfy himself that he knew what he was buying
