A FATHER of two assaulted his partner in kitchen of his home while their young children were asleep upstairs.
Elliot Rutter, 32, punched, pushed and slapped the woman, leaving her with a black eye, swollen cheeks, bruising to her bottom lip and a swollen nose.
Rutter pleaded guilty at Warrington Crown Court to assault, which put him in breach of a four-month suspended sentence.
The court heard Rutter had been drinking with his partner, who is now pregnant with their third child, before he grabbed her by the head and pushed her to the ground. He then punched and slapped her causing the injuries.
He was jailed for four months but Judge Thomas Teague decided not to activate the suspended sentence.
David Jones prosecuting told the court Rutter had been given a four-month sentence suspended for two years after he assaulted two police constables in November last year.
Simon Berkson, defending, said it was inevitable Rutter would receive a custodial sentence. But he had shown remorse since committing the assault.
