A LONG-running planning battle over a Warrington recycling firm’s bid to extend its operating hours is to continue.
Planning chiefs have deferred a decision again to allow the company time to produce more evidence.
ADS Recycling of Camsley Lane, Lymm is seeking a lawful development certificate to allow longer working hours on the grounds that planning conditions had been breached continuously for more than 10 years and therefore are unenforceable.
Earlier this year the company made a similar application and produced signed witness statements to support their application.
But a statement signed by 35 nearby residents disputed the claim, and planning bosses decided to support the residents.
Now the company has produced more signed statements, plus a letter from a Camsley Lane residents, in support of their case.
Planning officers are recommending that the planning committee again refuse the company’s application.
They say the council has no specific evidence to contradict the applicants’ version of events, but that the residents’ statements carry as much weight as those of the applicant.
But they say the onus of proof lies with the applicant and, on the balance of probabilities, they are recommending the lawful development certificate be refused.
The matter will be discussed again at the next meeting of the borough’s planning committee.

  1. Another example of incompetence from Warrington Borough Council’s Enforcement Team. Why on earth were the planning conditions breaches not enforced?? Incredibly over a 10 year period!! What is the point of imposing planning condtions if you are not going to enforce them?? This exactly the same scenario as outlined in the LGO report for the cul de sac in Culcheth. The developer breached almost every planning condition, causing considerable harm to residents and the Enforcment Team stood by and let it happen. Of note they were fully aware of the breaches, that is clear from the LGO report. The LGO slammed them over it. It is time for a full root and branch enquiry into the WBC Planning Department, as it appears they are simply not fit for purpose.

    Peter, these are not the only matters that the Planning department are unable or unwilling to take action upon. I agree entirely with you that a “full” investigation needs to undertaken without delay. I wonder if the new regime at the Town Hall since 5th May have the guts to carry this through!

  3. I sincerely hope so, if they don’t then pressure needs to be applied, maybe a facebook campaign? That seemed to be effective for the Sankey Valley Park group?
