Approval for garden extension onto railway land

A RETROSPECTIVE application for permission to extend a private garden onto an adjoining railway embankment has been approved by Warrington planning chiefs.

The scheme involved a house in St Mary Street, Latchford, Warrington – and includes retention of an outbuilding that protrudes into the railway land.

Planning chiefs were told the applicant acknowledged he did not own the land and did not know who the owner was.

It was assumed it was owned by the railway – although it was not known which company – and it had not been registered with the Land Registry.

Neighbours were consulted but none objected to the scheme and in officers’ opinion it had no detrimental impact on any neighbouring property.

The small encroachment into the embankment is not visible from outside the site.
