Tipping goes on after Arpley deadline expires

TIPPING is still going on at the giant Arpley landfill site at Warrington – despite its planning consent running out on Sunday.
This has been confirmed by the borough council, which says it will be considering all options over the next few days, including the potential serving of a planning enforcement notice.
Nearby residents, who have had to put up with heavy lorries pounding the roads near their homes for more than 20 years, are furious that waste is still being imported to the controversial site.
They say they have had to endure noise, vibrations, dust, smells and road safety hazards on a daily basis for far too long.
A council spokesman said: “A planning condition required the importation of waste to stop on October 13. The council sent officers to visit the site and it was evident that landfill waste was still being imported.
“The council will be considering all options over the next few days including the potential to serve a planning enforcement notice”.
The borough council refused an application to extend the life of the tip by 12 years in January.
In July, tip operators FCC Environment lodged an appeal and this is due to be held in February
Meanwhile last week the council received a further planning application
from the operator seeking to extend the life of the planning permission for the site for a further five years.
The company’s applications and the subsequent appeal are being opposed by all the political parties and residents of Sankey Bridges and Saxon Park.
More than 6,000 people have signed a petition objecting to any extension to the tip’s life.

Presumably, like the Company’s appeal against the Council’s decision to turn down its application to continue tipping beyond 13 October, the application to extend the life of tip for a further five years was submitted unreasonably late? So whilst arrangements are being made to determine those appeals the Company feels it is at liberty to continue tipping. This is par for course with the law of the land and lawyers. Meanwhile, the conditions applying to the original consent to tip seem to be of little relevance in the eyes of the Company. Correct me if I am wrong, but even if a planning contravention notice is served the Company can appeal against it and whilst that is being considered tipping can legally continue. As I’ve already said, the conditions applying to the orginal consent to tip count for little.
