A LYMM resident has won a lengthy planning battle with the borough council over proposals for a garden store with office space above it.
Eleven neighbours had objected to the plan in the grounds of a Grade 2 listed building at the junction of Cherry Lane with Old Smithy Lane and borough planners refused permission after visiting the site.
But a planning inspector has upheld the applicant’s appeal – which means the development can go ahead.
The objectors claimed the building would result in overdevelopment of the site, a loss of privacy and daylight for an adjoining house and would have a harmful impact on the listed building.
They also feared the building could later be converted into a separate dwelling.
But the inspector said the height of the building had been reduced from the original proposal and the proposal had also been set further back from the road, meaning it would not have any detrimental impact on the street scene nor cause loss of light or outlook to the other property.
Although there would be some overshadowing of a neighbouring garden, the harm would be slight.
